Terms & Conditions for the Mukuru – Premier Tobacco Campaign

  1. Introduction
    1. The Mukuru – Premier Tobacco Campaign (“the Campaign”) is being run by Send Money Home Private Limited  (Company Registration number 1446/2012)   (“Mukuru”) between 13 March – 31 July 2024 (“the Campaign Period”) subject to these specific terms and conditions and the general terms and conditions for Campaigns which can be found at www.mukuru.com (“Campaign Ts & Cs”).  
    2. By participating in the Campaign, you confirm that you have read and agree to be legally bound by the Campaign Ts & Cs.

  2. Campaign Entry Requirements:
    1. To qualify to participate in the Campaign, you must:
      1. be a registered Mukuru Customer in Zimbabwe (as defined by Mukuru); 
      2. be a Tobacco farmer in Zimbabwe;
      3. collect your cash payment through the Mukuru Branch situated on the Premier Tobacco Premises
      4. you must comply with these terms and conditions.
    2. Persons who fulfill the requirements of clause 2.1 above will be referred to as “Qualifying Participants” for the Campaign.
    3. Mukuru processes your personal information when you use the Mukuru Service. Protecting your personal information is important to Mukuru and processing is done according to our Privacy Notice. When we run competitions and you qualify for a Prize, Mukuru will need to process your personal information for additional purposes.  For example, your personal information may be used to validate your entry, make the reward available to you if you are a winner and potentially share your personal information with 3rd parties (including 3rd parties in other countries) who have a need to know.  We will ensure those 3rd parties have adequate data protection safeguards in place. Mukuru also announces the winners on social media.   If the Competition includes Mukuru wanting to post photos of you as a winner on social media, you will be asked if you agree thereto.  
  3. The Prize
    1. All Qualifying Participants will be entered into a monthly random draw to stand a chance of winning back the value of their collection (“Monthly Winner”) as stipulated in clause 2.1.
    2. Qualifying Participants will each receive 1 (one) entry into the specific monthly random draw for each collection within the same month the random draw took place, as stipulated in clauses 2.1 and 3.3.
    3. Collections made before or after a specific monthly random draw will not be considered. For the avoidance of doubt, the following periods will apply:
      1. Random draw 1 will be chosen out of collections between 1 March and 29 March 2024;
      2. Random draw 2 will be chosen out of collections between 30 March 2024 and 29 April 2024;
      3. Random draw 3 will be chosen out of collections between 30 April 2024 and 29 May 2024;
      4. Random draw 4 will be chosen out of collections between 30 May 2024 and 28 June 2024; and
      5. Random draw 5 will be chosen out of collections between 29 June 2024 and 29 July 2024.
    4. 1 Monthly Winner will be announced on the following dates:
      1.  29 March 2024 
      2. 29 April 2024
      3. 29 May 2024
      4. 28 June 2024
      5. 29 July 2024
    5. The Monthly Winners of the Prizes set out in clause 3 will be contacted telephonically within 48 hours of the Monthly Winners being announced and will also be announced on the local Mukuru Facebook Page after obtaining consent from the Monthly Winner. 
    6. If Mukuru is unable to contact the Monthly Winner within 3 (three) attempts over 7 (seven) days, the Prize will be forfeited and the next person will be contacted.
    7. All Prizes will be sent via a Mukuru DMT Order to the account the Monthly Winner used in terms of Clause 2.1 and may be collected at the nearest Mukuru Booth or Branch.
    8. If you are a winner of a Prize you agree that we may take a picture of you and/or receive a story and/or a picture from you on how you used the Prize. You agree that we may use such picture and/or story on all our social media platforms for marketing purposes relating to the Campaign and in this regard, you give us an unrestricted, perpetual, worldwide, royalty-free, irrevocable license to use your picture and/or story. You waive the right to inspect or approve any use of your picture or story by Mukuru and you waive any right to payment or additional consideration for Mukuru’s use of your picture or story. You release Mukuru from any actions, liabilities, losses, demands or claims that you or any third party may have now or in the future in respect of Mukuru’s use of your picture and/or story.  
    9. Should Winners wish for their photos not to be taken and published, they should indicate that when consent is requested by our Marketing Department.
  4. General
    1. Mukuru employees and agents will not be allowed to enter the Campaign. 
    2. Qualifying Participants must be 18 years or older.
    3. Qualifying Participants cannot decline a Prize or negotiate a different Prize than the one allocated by the random monthly draw.
    4. If for any reason, the Campaign cannot run as planned because of any technical failures, unauthorised intervention, computer virus, mobile network failure, stock unavailability, tampering, fraud or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Campaign, we reserve the right to cancel, terminate, modify, suspend or cancel the Campaign and/or to disqualify any individual who (whether directly or indirectly) causes (or has caused) the problem. 
    5. Mukuru may vary the terms of or cancel the Campaign at any time. Mukuru may vary or cancel the Campaign at any time without any liability to any person involved directly or indirectly in the Campaign. 
    6. The reward is not transferrable for cash or vice versa. 
    7. Mukuru cannot be held liable for any loss, expense or damage to any person participating in the Campaign. Mukuru does not endorse the Prize and the Prize is made available “as is”. Any warranties available in respect of the Prize will be those made available by the manufacturer and Mukuru makes no warranties as to merchantability, functionality, fit-for-purpose or quality.
    8. A failure by Mukuru to enforce any one of the terms and conditions in any instance(s) will not give rise to any claim or right of action by any Qualifying Participant. If Mukuru does not enforce a provision, this will not mean that Mukuru has given up on or lost any rights.
    9. Mukuru will not assume any liability to any participant, or Qualifying Participant in connection with or arising out of the Campaign however it is caused, including for any costs, expenses, forfeited rewards, damages and other liabilities 
    10. These Campaign Terms and Conditions are governed by the laws of Zimbabwe.
