Mukuru Competitions Terms and Conditions

STANDARD TERMS & CONDITIONS FOR COMPETITIONS AND PROMOTIONAL OFFERS

1. Definitions:
   1. “Remitix Affiliate” means any entity contracted by Remitix Limited to register customers as users of the Mukuru Service, create money transfer orders, accept payment for those orders, and/or pay out money transfer transactions on behalf of Remitix Limited.
   2. “Competition” means any promotional activity run by Remitix Limited or its Affiliates, including competitions, campaigns, and promotions. Competitions may be skill-based or chance-based and may take place online or offline.
   3. “Prize” means anything of value awarded to a winner as part of a Competition, including prizes, awards, or rewards.
2. Acceptance of Terms
   1. By entering any Competition conducted or promoted by Remitix Limited or its Affiliates, you agree to these standard terms and conditions, as well as any additional terms that apply specifically to that Competition.
   2. If there is any conflict between these standard terms and the Competition-specific terms, the Competition-specific terms will prevail. 
3. Eligibility
   1. Competitions are open only to persons aged 18 years or older. Remitix Limited or its Affiliates may request proof of your age or residency at any time
   2. You may not enter or participate in a Competition if you are:
      1. subject to any international, regional, or local sanctions;
      2. listed on any sanctions, terrorism, or restricted-party list; or
      3. located in, ordinarily resident in, or a citizen of a country or territory subject to comprehensive sanctions.
   3. Remitix Limited and its Affiliates reserve the right to disqualify any participant or withhold a Prize if awarding the Prize would breach any applicable law, regulation, sanction, or internal compliance policy.
4. How to enter
   1. Details on how to enter each Competition will be set out in the Competition advertisement and/or the Competition-specific rules
5. Closing dates and late entries
   1. You are responsible for ensuring that Mukuru receives your entry before the Competition closing date.
   2. Entries received after the closing date will not be eligible, regardless of the reason for the delay. Remitix Limited or its Affiliates are not responsible for late, lost, incomplete, or misdirected entries, for any reason
6. Costs of entry
   1. Any costs you incur that are not specifically included in a Prize are your responsibility.
   2. If you enter using a mobile phone or other device, you are responsible for all call, SMS, data, or internet charges. Remitix Limited or its Affiliates will not be liable for any costs incurred in entering a Competition or accepting or using a Prize.
7. Accuracy of information
   1. You must ensure that all information you provide is accurate, complete, and up to date.
   2. If any information you provide is false, misleading, incomplete, or invalid, your entry may be disqualified. Remitix Limited or its Affiliates may also prohibit you from entering future Competitions for a period determined at their sole discretion.
8. No guarantees
   1. Remitix Limited or its Affiliates do not guarantee that:
      1. your entry will result in winning a Prize;
      2. a Prize will meet your expectations or requirements; or
      3. a Prize will be defect-free, safe, reliable, punctual, or satisfactory
9. Prize restrictions
   1. Prizes are not transferable and may not be deferred, exchanged, or redeemed for cash or any other item.
   2. If it is unlawful for Remitix Limited or its Affiliates to supply a Prize to you, you will forfeit that Prize. Remitix Limited and its Affiliates may exclude participants from certain countries or regions at any time, without prior notice, if required by law, regulation, or operational constraints.
10. Legal requirements
    1. You are responsible for obtaining any documents, permissions, visas, or approvals required to accept or use a Prize.
11. Winner notification and collection
    1. Winners will be notified using the contact details they provided.
    2. If Remitix Limited or its Affiliates cannot contact a winner or transfer the Prize within 7 days (or another period stated in the Competition-specific terms), or if the winner does not collect the Prize within 30 days (or another stated period in the Competition-specific terms), the Prize will be forfeited.
    3. In such cases, Remitix Limited or its Affiliates may, but is not obliged to, select another winner.
12. Regulatory and processing delays
    1. Delivery of a Prize may be delayed or withheld where additional verification, regulatory approval, or compliance checks are required.
    2. Remitix Limited or its Affiliates will not be liable for delays caused by third parties, financial institutions, regulators, or compliance obligations.
13. Proof of prize delivery
    1. Remitix Limited or its Affiliates will only be required to provide proof that a Prize was delivered if you request it within six (6) months of the Competition’s end date.
    2. Requests made after this period will not be considered, and Remitix Limited or its Affiliates will not be liable for any resulting loss.
14. Additional verification
    1. Remitix Limited or its Affiliates may request additional information, including Know Your Customer (KYC) procedures, or documents reasonably required to process or deliver a Prize.
    2. If you refuse to provide the requested information, you will forfeit the Prize.
15. Data Protection and cross-border transfers
    1. By entering a Competition, you consent to the collection, use, and processing of your personal information for Competition administration, compliance, and Prize fulfilment.
    2. Your personal data may be transferred to and processed in countries outside your country of residence, including countries that may not provide the same level of data protection.
    3. Remitix Limited or its Affiliates will process personal data in accordance with applicable data protection laws and their Privacy Notice.
16. Publicity and marketing
    1. Remitix Limited or its Affiliates may invite you to participate in publicity or marketing activities related to the Competition, including media appearances or promotional content. Your personal details may also be used to announce you as a winner, or share a post of you receiving/using your Prize.
    2. Participation is entirely voluntary. You may decline or withdraw consent at any time. No payment or compensation will be provided for participation.
17. Risk
    1. You participate in the Competition and accept or use any Prize entirely at your own risk.
18. Force Majeure
    1. Remitix Limited or its Affiliates will not be liable for any failure or delay in performing their obligations where such failure or delay results from events beyond their reasonable control, including but not limited to natural disasters, war, sanctions, government actions, system failures, or payment network disruptions.
19. Limitation of liability
    1. To the extent permitted by law, Remitix Limited, its Affiliates, agents, and service providers will not be liable for any direct or indirect loss, damage, injury, death, defamation, or other claims arising from participation in a Competition or use of a Prize.
20. Breach of terms
    1. If you breach these terms, Remitix Limited or its Affiliates may, without limiting any other rights:
       1. disqualify you and forfeit any Prize awarded;
       2. recover any losses or damages caused by your breach, including legal costs; and
       3. require you to indemnify and hold them harmless against any claims arising from your breach
21. Governing Law
    1. These terms are governed by the laws of the country in which the Competition is run.
22. Right to amend
    1. Remitix Limited or its Affiliates may amend these terms at any time to comply with changes in law, regulation, or regulatory guidance.
    2. Any material changes will be published on the website or communicated where required.
23. Final Decision
    1. All decisions by Remitix Limited or its Affiliates regarding any aspect of a Competition are final and binding. No further correspondence will be entered into.
